TEXAS JUSTICE COURTS

$20,000Justice of the Peace courts have jurisdiction to hear civil cases for up to $20,000.

Most credit card debt lawsuits are filed and heard in Justice of the Peace courts because the amount claimed is under $20,000.

“SMALL CLAIMS” HAS CHANGED

Justice Court rules are simpler, but the consequences are real.

Texas Justice of the Peace courts hear debt claims up to $20,000. These courts are often still called “small claims courts,” although Texas now treats small claims and debt claims as distinct case types under the Justice Court rules.

Ignoring the lawsuit can lead to a default judgment. A creditor with a judgment may pursue post-judgment collection, which can include garnishment of a non-exempt bank account. Texas law protects certain property and funds, and the result depends on the source and status of the money.

County and district court filings are more complicated.

When a creditor sues for a higher dollar amount in a county or district court, hiring a lawyer can be especially helpful. Pleading standards, electronic filing, service, discovery, motions, evidence, and deadlines are generally more complicated than in Justice Court.
