A credit card debt lawsuit is a civil case seeking payment of an allegedly unpaid credit card balance. The plaintiff may be the bank that issued the card or a company that later purchased the account. Most credit card lawsuits seeking $20,000 or less are filed in a Texas Justice of the Peace court as debt claim cases.
The plaintiff must prove that the account belongs to the defendant, that the plaintiff has the right to collect it, and that the amount requested is supported by evidence. The fact that a lawsuit was filed does not by itself establish that every amount listed in the petition is correct.
Credit card cases may be resolved through dismissal, settlement, an agreed judgment, trial, or another court ruling. The result depends on the account history, the evidence, the applicable law, and the procedures of the particular court.
